The outcome of your drunk driving case depends on a number of factors: the jurisdiction where you are charged, the circumstances of your arrest, prior DUIs, and any related charges, such as minor children in the car or drunk driving accidents.

  • First offense — If this is your first DUI arrest, you will probably receive a suspended jail sentence and probation if convicted. Your license will be suspended for 30 days up to one year, possibly with restrictions once you are reinstated.
  • Second or subsequent offense — Indiana has a lifetime lookback, resulting in being charged as a repeat offender even if your previous DUI was 20 years ago. Jail time is likely, especially if your previous conviction was recent, and your license may be suspended for a year or more. On a third offense, you could face substantial jail time and permanent license revocation.
