  • Spousal Maintenance (Alimony)

Maintenance is not commonly awarded in Indiana divorces, unless one spouse has special needs or limited employment skills. Rehabilitative maintenance may be granted for up to three years in order to return to school or job training to gain financial independence.

  • Child Custody

In Indiana, the presumption is joint physical custody of children, with one spouse awarded primary custody and the other getting parenting time ("visitation"), and joint legal custody, with both parents sharing in decisions about education, religious upbringing, and other matters. Sole custody (physical and/or legal) requires demonstrating that the other parent is unfit or abusive. The court may require mediation, including hiring a licensed psychologist to perform custody evaluations. Our child custody lawyers will help you negotiate a realistic parenting plan, and fight for you to ensure that you are fairly treated and that the best interests of your children are taken into account.

  • Child Support

The state guidelines consider your incomes, child care and health insurance expenses, whether there are other children to support, and the parenting time split (number of overnights) in determining child support. We ensure that the court has full and accurate information to make a fair decision.
