Estate Administration

Practicing law in Indiana since 1972, David Murphy offers extensive knowledge of estate administration, including an understanding of current probate laws of Indiana.

If the estate is valued at under $25,000, it can be settled without going through the probate process. We can help the client prepare a Small Estate Affidavit and retrieve any assets of the estate held by other persons. Assets held in a trust also bypass probate, and are distributed to heirs by the appointed trustee per the provisions of the trust. We can advise trustees in reporting requirements and other trust administration duties.

David P. Murphy & Associates assists the personal representative ("executor") in all the prescribed estate administration duties:

  • Inventory of the estate
  • Notifying creditors and paying debts of the estate
  • Liquidating assets as necessary
  • Distributing remaining assets to heirs
  • Filing income tax and inheritance tax returns

Probate Litigation

Mr. Murphy is a veteran trial lawyer who can handle all disputes arising from the settling of an estate. He advocates for beneficiaries, parties excluded from the will, or personal representatives regarding:

  • Contested wills — Disputes among beneficiary spouses, children, relatives, or excluded heirs, including claims of undue influence, lack of testamentary capacity of the deceased, or unproved wills (not witnessed or improperly notarized).
  • Breach of fiduciary duty — Allegations against the personal representative of theft, excessive expenses, or mismanagement of the estate
