Modifications and Enforcement

Our family law lawyers are knowledgeable about recent changes in Indiana law affecting custody and support. You can be assured that we will fight for you, whether you are seeking a modification or challenging the other parent's petition in court.

  • Child Support — Either party may request a modification of child support if there has been a substantial increase or decrease in income. We investigate the other party's finances and living arrangements to make sure the court has accurate information about expenses or true income.
  • Enforcement — If the other party is not paying court-ordered support, we take swift action. The non-paying parent may be jailed, with work release to meet support obligations, or we will pursue wage garnishment. If the other parent is not complying with the parenting time agreement, we will seek the quick resolution of this sort of matter by enlisting the court.
  • Child Custody — Sometimes parents agree to change the parenting plan (increasing or decreasing overnights, changing pick-up and drop-off schedules, a child's wish to live with the other parent). We can negotiate the new terms and draft the agreement. We also handle contested custody modifications, such as a petition for sole custody, vigorously pressing our client's case.
  • Parent Relocation — One parent's desire to move out of state with the children is usually hotly contested by the other parent. Recent legislation places a stricter burden on the relocating parent to prove the move is in the child's best interests. We represent either party, preparing a compelling argument for the custody judge.

Adoption and Guardianship

  • Private adoptions
  • Stepparent adoptions (including termination of parental rights)
  • Guardianship and/or family adoption — minor children placed with grandparents or family members because the parents are deemed unfit or abandoned the child. If the guardianship is contested, we represent the guardians before the court to show why the temporary placement or grandparent adoption is in the child's best interests.

Paternity

We represent mothers seeking support, and fathers seeking to establish parentage and parenting time. As necessary, we can arrange or compel DNA testing.
